ECHO Terms of Service
Welcome to ECHO. By accessing or using the ECHO app, website, API, cloud sync, collaboration, research, export, publishing, or notification features, you agree to these Terms of Service. If you do not agree, do not use the service. This page explains service rules and is not legal advice.
1. Service Description
ECHO is a tool for recording, organizing, analyzing, and sharing observations. The service may include local archives, camera and sensor capture, location and direction tracks, cloud sync, media uploads, maps, groups, comments, notifications, exports, verification, triangulation, research datasets, and public publishing.
2. Accounts and Security
- Some features require Apple sign-in or another account mechanism.
- You are responsible for protecting your credentials, device, and account access.
- You should notify us promptly if you discover unauthorized access or a security issue.
- We may suspend, restrict, or terminate accounts when reasonably necessary for security, legal compliance, or violation of these terms.
3. User Content
You retain your rights in observation records, media, comments, tags, descriptions, and other content you create or upload. You grant us a non-exclusive, worldwide, sublicensable license to host, store, process, transmit, display, analyze, sync, back up, export, moderate, and improve the service using that content.
When you publish content, join groups, participate in collaboration rooms, or authorize research use, you also authorize us to show or process the relevant content according to your selections. You are responsible for ensuring that you have the rights needed to upload, share, or authorize processing of the content.
4. Acceptable Use
You may not use ECHO to:
- Violate law or infringe privacy, intellectual property, publicity, reputation, or other rights.
- Upload unlawful, harassing, hateful, threatening, fraudulent, malicious, or seriously misleading content.
- Record, track, locate, identify, or disclose sensitive information about another person without appropriate consent.
- Bypass permissions, access controls, rate limits, security controls, or moderation systems.
- Interfere with the service, distribute malware, scrape non-public data, or perform unauthorized reverse engineering, scanning, or attacks.
- Use ECHO in high-risk, emergency response, aerospace, medical diagnosis, law-enforcement attribution, or other professionally certified contexts as the sole basis for decisions.
5. Observations, Analysis, and Verification
ECHO sensor records, camera analysis, maps, verification, triangulation, and research outputs may be affected by device accuracy, environment, permissions, network conditions, algorithm versions, and user input. Results are provided for recordkeeping, assisted analysis, and collaboration only. We do not guarantee that results are complete, accurate, available, or suitable for any specific purpose.
6. Privacy
We process personal information according to the ECHO Privacy Policy, which is part of these terms. When using permission-based or cloud-synced features, you should understand the related data handling.
7. Third-Party Services
ECHO may rely on Apple, cloud hosting, object storage, push notification, identity, map, security, analytics, or other third-party services. Third-party services may be governed by their own terms and privacy policies. We are not responsible for third-party service behavior, availability, or content.
8. Paid Features
If ECHO offers subscriptions, paid features, or in-app purchases, pricing, billing, renewal, refund, and cancellation rules will be shown in the purchase interface or applicable platform terms. Completed purchases may be non-refundable unless required by law or platform rules.
9. Service Changes and Termination
We may add, modify, suspend, or discontinue features, and may adjust APIs, models, sync, storage, community, or research functionality. You may stop using the service or delete your account at any time. We may also limit or terminate access if you violate these terms, create risk, or if required by law.
10. Disclaimers
To the maximum extent permitted by law, ECHO is provided "as is" and "as available." We make no express or implied warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, uninterrupted availability, non-infringement, or that errors will be corrected.
11. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, punitive, consequential damages, or loss of profits, revenue, data, goodwill, or business opportunity. Our total liability related to your use of the service is limited to the greater of the amount you paid for ECHO in the 12 months before the event giving rise to liability or USD $100.
12. Indemnity
If claims, losses, liabilities, expenses, or costs arise from your content, your use of the service, your violation of these terms, or your infringement of third-party rights, you agree to indemnify and hold us harmless to the extent permitted by law.
13. Changes to These Terms
We may update these terms. Material changes will be announced through the app, website, or another reasonable method. Continued use of the service after an update means you accept the updated terms.
